I Made Sari Received Doctoral Degree in Law with a Dissertation Titled: “Construction of Authority for Seizure Guarantees of the Competition Supervisory Commission in a Comparative Perspective”

 

Denpasar –Open Doctoral Promotion Examination with Promovendus I Made Sari was held in a Hybrid manner on 20 May 2022 in the Hall of the Faculty of Law, Udayana University with a dissertation entitled "Construction of Regulatory Authority for Seizure Guarantees of the Business Competition Supervision Commission in a Comparative Perspective". The Doctoral Promotion Open Examination which lasted for approximately 3 hours was led by the Co-Prodi Doctor of Law, Faculty of Law, Udayana University, Prof. Dr. I Putu Sudarma Sumadi, SH., MS; Prof. Dr. Ni Ketut Supasti Dharmawan., SH., M. Hum., LLM as the Promoter; Dr. Marwanto, SH., MH as Co-promoter; Dr. I Made Bachelor, SH., MH as the Co-promoter II, and presented the external examiner Prof. Dr. Irwansyah, SH, MH from Hasanuddin University Faculty of Law and 3 other examiners/debaters. I Made Sari in her dissertation revealed that the nature of the KPPU as a law enforcement agency and justice in the field of business competition cases can be given the authority to confiscate guarantees in examining cases related to compensation and fines cases so that decisions are not illusory. Legislators can adopt the norms of confiscation authority as adopted by business competition institutions in the civil law and common law legal systems. Thus, the KPPU in Indonesia can confiscate guarantees to ensure the certainty of the execution of the KPPU's decision by the court regarding the decision on fines and compensation, which has permanent legal force.
