Denpasar, FLUNUD.ac.id - Doctoral promotion on behalf of I Putu Sauca Arimbawa Tusan by the S3 (Doctoral) Law Study Program (PDIH) FH UNUD was held on Friday (12/05/2023) at the FH UNUD Hall, Denpasar Campus. I Putu Sauca Arimbawa Tusan, who works as a prosecutor at the Bali High Prosecutor's Office, successfully earned his doctorate with a dissertation entitled "The Concept of Restorative Justice in Resolving the Spread of Fake News and Hate Speech in Indonesia."
The doctoral promotion was led directly by the Dean of Faculty of Law UNUD (Prof. Dr. Putu Gede Arya Sumerta Yasa, S.H., M.Hum.) accompanied by the Promoter Team: Prof. Dr. Ibrahim R., S.H., Dr. Gde Made Swardhana, S.H., M.H., Dr. Sagung Putri M.E. Purwani, S.H., M.H. and 3 other examining lecturers. I Putu Sauca Arimbawa Tusan's dissertation discussed 3 problem formulations, namely: (1) What is the philosophical nature of restorative justice in the settlement of criminal acts of spreading false news and spreading hate speech?; (2) How is the regulation of the settlement of criminal acts of spreading false news and spreading hate speech in Indonesia?; (3) How is the concept of Rea justice in the Electronic Information and Transaction Law for the settlement of spreading false news and hate speech in Indonesia in the future?.
The results showed that the philosophical nature of restorative justice in solving the criminal offense of spreading fake news and spreading hate speech can be seen in the philosophy of the 4th principle of Pancasila. So that the concept of restorative justice is in accordance with the values of Pancasila which philosophically as the source of all laws in Indonesia provides space for the concept of restorative justice to be applied.
The regulation of the criminal offense of spreading false news and spreading hate speech in Indonesia is regulated in the ITE Law jo. ITE Law jo. ITE Law Amendment and Criminal Code. However, there is no formulation of the provisions of the criminal offense of spreading false news and spreading hate speech that emphasizes its settlement with restorative justice in Indonesian legislation.
The concept of restorative justice for the settlement of the spread of false news and hate speech in Indonesia in the future can be done by revising the provisions on the spread of false news in the ITE Law jo ITE Law Amendment by including a restorative justice settlement. The restorative justice approach in the criminal justice system can be carried out with an integrated system, meaning that it is carried out in stages from the investigation, prosecution and judicial stages.
